| چکیده تعدیل قضایی قراردادهای پیمان کاری نفتی در شرایط اعمال تحریم از مفاهیم حقوقی – اقتصادی است که در نتیجه تحریم های اخیر حادث شده است. با توجه به مفاهیم حقوقی و اقتصادی ارائه شده برای تعدیل قرارداد در شرایط اعمال تحریم به نظر می رسد کاهش ارزش نفت مبنای مناسبی است. اما تعدیل قضایی قراردادها در نظام حقوقی ایران جز در موارد خاص و استثنایی مورد پذیرش قرار نگرفته است. کاهش ارزش نفت نیز با توجه به ماهیت آن ضمان آور و قابل جبران است. اما نکته حایز اهمیت این است که قبل از بررسی تعدیل، امکان حفظ قرارداد با همان ماهیت قبلی وجود داشته باشد. بنابراین ممکن است در برخی موارد تعدیل قابل توجیه نباشد. با توجه به فقدان نظام جامع قراردادهای اداری در حقوق ایران و نامشخص بودن جایگاه عوامل پیدایش تعدیل در قراردادهای اداری، تعدیل قضایی قراردادهای پیمان کاری نفتی در شرایط اعمال تحریم ، موضوعی بحث برانگیزتر است که ابعاد آن در این مقاله بررسی میشود. Abstract Judicial modification of oil contracting contracts during sanctions is among legal-economic concepts which is the result of recent sanctions based on suggested legal-economic concepts to modify contracts in conditions of sanctions. It seems that the reduction in oil value is an appropriate criterion. But juridical modifications of contracts in the Iranian legal system is not accepted except for special exceptional cases. The reduction of oil value, considering its nature, can be guaranteed and amended. But the significant point is to keep its former nature before analyzing its juridical modification. Thus, in Some cases, the modification of contracts is not justifiable. Nothing the absence of a comprehensive system of administrative contracts in Iran’s legislative system and non-specification of the sources for the formation of modifications in contracts, the subject of Modification oil juridical contracts during sanctions, is a controversial topic whose aspects will be discussed in this paper. |
